What to know when selling as a non-resident in Spain
- NIE
- You need your foreigner identity number (NIE). If you bought in Spain, you already have one.
- The 3 % withholding
- If you are not tax resident in Spain, the buyer withholds 3 % of the price and pays it to the Spanish Tax Agency on account of the tax on your gain. You then file the sale and, if you paid too much, the difference is refunded.
- Municipal capital gains tax (plusvalía)
- The town hall charges it to the seller on the value of the land. If there is no gain, it does not apply.
- Signing by power of attorney
- The power of attorney is signed before a notary in your country (with an apostille) or at a Spanish consulate, and your representative signs the sale for you.
- Documents
- Title deed, latest property tax (IBI) bill, energy certificate, habitability certificate (cédula) and the latest community fee receipts.
General guidance only: every tax situation is different. If needed, we can put you in touch with a tax adviser.

Frequently asked questions
Do I need to come to Spain to sell?
Not necessarily. We can handle viewings and paperwork with your keys, and the sale can be signed by someone holding your power of attorney.
What happens to the 3 % withholding?
It is a payment on account of the tax on your gain, not an extra tax. After the sale you file your return and, if the tax due is lower, the difference is refunded.
How much does your service cost?
The valuation is free. Our fee is only payable if we sell your home.
Which languages do you work in?
English, Spanish, Catalan, French and German.
