Selling in El Port de la Selva: what buyers look at
El Port de la Selva is a small fishing village on a north-facing bay, surrounded by the Cap de Creus Natural Park. It is a low-turnover market: few houses come up for sale, and whoever buys has usually been waiting some time for the right one. The range runs from the fishermen's houses of the old centre and the apartments by the harbour to the houses on the hillside developments, with views over the bay and, up above, the monastery of Sant Pere de Rodes.
What buyers value is the sea view, being close to the harbour and the beach, the terrace and the peace and quiet out of season. Many own a boat or want one, and ask about berths in the marina. The tramontana wind is part of the village's character, which is why the orientation of a terrace and how sheltered it is count for more than elsewhere on the coast.
Buyers are mostly looking for a second home: French, thanks to the nearby border, Catalan, and from central and northern Europe, with a relaxed, boating and nature-loving profile. Because the village sits inside or next to the natural park, and some houses are right on the seafront, it is worth being clear before selling about the house's planning status and whether the Ley de Costas affects it. We review this with you when preparing the sale.

Sellers' questions in El Port de la Selva
How long does it take to sell a house in El Port de la Selva?
It is a low-turnover market, with few buyers but very determined ones. What shortens the timeline most is going to market with a price in line with the market from day one and with the paperwork ready; in a small village, an overpriced house becomes stale and is harder to revive.
My house is on the seafront: does the Ley de Costas affect me?
It may. On the seafront you need to check whether the property falls within the protection easement of the public maritime-terrestrial domain under the Ley de Costas (Spain's Coastal Law), because it limits the works that can be carried out. It does not stop you selling, but the buyer will ask, and so will their bank; we check it before listing.
What does the Cap de Creus Natural Park mean for my house?
Much of the municipality lies within the natural park or around it, with limits on building and extending. To sell without surprises, it is worth asking the Town Council for the property's certificado urbanístico (planning certificate) and confirming that everything built is recorded in the deed and the catastro (land registry).
My house is old and will get a poor energy rating: can I sell it?
Yes. The energy certificate is compulsory for selling and the rating must appear in the advert, but a low rating does not prevent the sale. In Catalonia it is drawn up by a qualified technician and registered with the ICAEN (Catalan Energy Institute); as well as the rating, the certificate includes recommended improvements, which are useful to a buyer planning to renovate.
I live in France: what taxes do I have to pay when selling?
In Spain, as a non-resident: the buyer withholds 3 % of the price (modelo 211, the withholding form) and you declare the gain with modelo 210 (the non-resident tax return), at 19 %, deducting that withholding. You also pay the plusvalía municipal (municipal capital-gains tax on land) to El Port de la Selva Town Council. In France, the double taxation treaty applies. We can put you in touch with advisers who work in French.
Which costs are shared with the buyer in the sale?
The year's IBI (annual property tax) is usually apportioned by days from the date of the deed, and community fees are paid up to the date of the sale. The plusvalía municipal (municipal capital-gains tax on land) and cancelling the mortgage, if there is one, are the seller's responsibility; notary costs are split according to the law or what was agreed in the arras (deposit contract).
